Texas woman sues BP for infant death

A Texas woman is suing BP claiming her son’s death resulted from emissions released at the company’s Texas City refinery earlier this year.

BP faces a state investigation for releasing more than 500,000 pounds of material, including several tons of benzene, into the air. The 40-day incident started April 6 and ended May 16, according to the Texas Commission on Environmental Quality and BP.

Benzene is a known carcinogen.

The lawsuit, filed Thursday morning in the 212th State District Court, claims the 6-month-old child was diagnosed with pneumonia and that symptoms got worse in April and May while the infant was being cared for at an aunt’s house and a nearby day care center.

BP maintains the release posed no threat on the community and that air monitors at the refinery and from the community monitoring network detected no dangerous concentrations of harmful emissions.

The baby died June 23.

Parking lot dust could cause cancer

A cancer-causing chemical used to seal pavement, paring lots and driveways is showing up in dust in American homes, and at alarming levels, claims a new study.

The class of chemicals, polycyclic aromatic hydrocarbons or PAH, are a significant component in coal tar. Coal tar is a waste product of steel manufacturing. One of the principal PAH chemicals, benzo[a]pyrene, has long been regarded as a deadly carcinogen.

A study commissioned by the United States Geological Survey compared house dust from 23 ground-floor apartments in Austin — 11 with coal tar-sealed parking lots and 12 coated with other substances, or not sealed at all. The study found that dust in the apartments next to the coal-tar-sealed lots had  pollution levels 25 times higher, on average, than the other lots.

More than half the apartments with the coal tar-sealed lots had dust with levels of PAHs that would increase the risk of cancer if ingested by preschoolers, the researchers said. The dust inside several suburban homes in the Austin area were also examined and found to contain benzo[a]pyrene thousands of times the level that would trigger a cleanup at a toxic-waste site.

Children are at greatest risk to these kinds of chemicals because they have a higher metabolic rate, they get a bigger dose per pound of body weight, their organs are still developing and they play on or near floors where carpets concentrate and retain toxins. Emerging evidence also suggests that babies exposed to PAHs while in the womb may be more prone to asthma and other ailments and may have lowered IQs.

Texas chemical plant hit with fines

A Formosa Plastics’ plant in Point Comfort, Texas was fined $121,443 for repeated violations of environmental regulations over two years.

Scream 3 psp Formosa officials insist it is working to improve its environmental record and complies with all clean air regulations. Environmentalists doubt that a fine of only a few thousand dollars will deter a multi-billion dollar company from dumping toxic waste.

Regardless, Formosa still faces a lawsuit resulting from a 2005 fire that injured workers and released thousands of pounds of unpermitted gasses,  including carbon monoxide, benzene, nitrogen oxides, methane, propylene and volatile organic compounds, into the air.

Subcontractors who were at the plant during the fire sued Formosa in 2006 because they were injured while trying to escape the fire and vapors, John Griffin, a Victoria attorney, said. Marek, Griffin and Knaupp has offices both in Victoria and Port Lavaca.

The workers suffered burns, leg injuries and herniated discs in their backs, and some required surgery, he said.

“They were injured from jumping off structures out of fear for their lives,” he added. “It was quite literally a disaster scene. It was just horrible.”

One case involving eight people is currently in the discovery phase and should be tried by early next year, Griffin said. He represents 100 workers.

INVISTA DISCOVERS ENVIRONMENTAL ISSUES LESS THAN A MONTH AFTER PURCHASING PLANT FROM DUPONT

          DuPont-Victoria, Texas, sold their Textile and Interiors business to Invista for $4 billion on April 30, 2004.  Less than a month after the sale, Invista claims it discovered serious environmental hazards and public health risks, and as a result of these findings they have now has filed suit for $800 million.  Among the first finds was the benzene treatment unit which the lawsuit claims DuPont had operated illegally since 2000.

            According to the lawsuit, Invista had to act swiftly and report the violations and avoid criminal prosecution.  Invista, EPA and the Department of Justice have agreed to a consent decree in which the company will pay a civil penalty of $1.7 million and install major pollution controls at its various plants to resolve DuPont’s failures.          Invista has filed suit in the U. S. District Court Southern District of New York which also seeks punitive damages “because DuPont knew of several of the more dangerous safety and environmental violations, knew those violations placed its workers and the public at risk, took no action to rectify them, and failed to disclose them to Invista.”

          Short-term benzene inhalation could cause drowsiness, headaches and irritation in humans, while long-term exposure could include blood and reproductive disorders, according to the Environmental Protection Agency website.  Long-term exposure to high levels of benzene in the air can cause leukemia.
