W.R. Grace still trying to sidestep Libby asbestos deaths

When confronted with evidence that damages their cases, corporations resort to what’s known as a Daubert hearing. This legal maneuver can keep crucial evidence, including the corporation’s own science showing the danger of its products, from being presented to juries.

W.R. Grace, the owner of a mine that spewed asbsestos-contaminated dust and mine tailings all over a small community for decades endinging the mid 1990s.

In 2005,  two federal grand juries evaluated the government’s evidence of criminal wrongdoing and called for Grace to be charged with a variety of criminal charges. Among them was that Grace knowingly endangered the lives of thousands of people by concealing the hazard from the dust released by mining the asbestos-tainted vermiculite ore from nearby Zonolite Mountain.

The U.S. Supreme Court has declined to hear the case, which is scheduled to go to trial next month … if the Daubert hearing dosen’t gut the government’s case.

Asbestos exposure can result in a variety of nasty diseases including asbestosis and malignant mesothelioma cancer. Asbestosis is also known as pulminary fibrosis. Mesothelioma is an aggressive form of lung cancer with no known cure and few effective treatments.

And, while highly-paid defense attorneys spar with federal prosecutors over proven science, people in Libby and at the dozens of processing sites across the country that handled the vermiculite ore continue to die. The survivors wonder whether Grace will ever be held accountable.

A doctor in Frankfurt is exploring the use of chemoembolization to treat mesothelioma, and anecdotally, the treatment has shown some promise.

Dr. Thomas Vogl has studied the use of chemoembolization to treat tumors in the liver, and has demonstrated that the procedure, while minimally invasive, can be helpful to patients.

The Deep full More study is needed to determine what the benefits will be for mesothelioma  patients, but given this cancer’s resistance to current treatments, the development of new treatment options is vital. There is interest in conducting clinical trials on the treatment in the UK and elsewhere.

Mesothelioma claims life of former MLB pitcher

A major league pitcher who played for the 1979 World Series Champion Pittsburg Pirates died of mesothelioma cancer recently.

Family members said Dave Roberts was exposed to asbestos while working as a boilermaker during off seasons as a young man. As a result of the asbestos exposure, he developed mesothelioma.

Mesothelioma is a very aggressive form of lung cancer, which can involve the lining of the lungs, heart or abdomen. Generally the effects of asbestos exposure aren’t seen until decades later. It is usually fatal within 18 months of diagnosis.

Roberts was a lefty with a 13-year career in the majors.  Between 1969 and 1981, he played for a total of eight teams, including the San Diego Padres, San Francisco Giants, New York Mets, Houston Astros, Chicago Cubs, Seattle Mariners and Detroit Tigers. Roberts went 103-125 with a 3.78 ERA.

Roberts died at his home in Short Gap, Pen. He was 64.
