Ft. Lauderdale Jury Awards Couple $3.6 Million in Secondhand Asbestos Exposure Case

A Broward County jury awarded a Florida woman and her husband $3.6 million in case of a secondhand exposure to asbestos.

The woman worked for several years during the late 1970s at two different Ford dealerships in Wisconsin where, her attorneys argued, she was exposed to asbestos-containing brakes. She was diagnosed with mesothelioma in 2007.

Texas chemical plant hit with fines

A Formosa Plastics’ plant in Point Comfort, Texas was fined $121,443 for repeated violations of environmental regulations over two years.

Scream 3 psp Formosa officials insist it is working to improve its environmental record and complies with all clean air regulations. Environmentalists doubt that a fine of only a few thousand dollars will deter a multi-billion dollar company from dumping toxic waste.

Regardless, Formosa still faces a lawsuit resulting from a 2005 fire that injured workers and released thousands of pounds of unpermitted gasses,  including carbon monoxide, benzene, nitrogen oxides, methane, propylene and volatile organic compounds, into the air.

Subcontractors who were at the plant during the fire sued Formosa in 2006 because they were injured while trying to escape the fire and vapors, John Griffin, a Victoria attorney, said. Marek, Griffin and Knaupp has offices both in Victoria and Port Lavaca.

The workers suffered burns, leg injuries and herniated discs in their backs, and some required surgery, he said.

“They were injured from jumping off structures out of fear for their lives,” he added. “It was quite literally a disaster scene. It was just horrible.”

One case involving eight people is currently in the discovery phase and should be tried by early next year, Griffin said. He represents 100 workers.

Researchers search for early test for lung cancer

There is no effective screening test for the early detection of lung cancer, which has led to a discouraging survival rate of 5 years for 15 percent of patients.

To combat this dismal statistic researchers in Canada are beginning a massive research project aimed at finding a simple method to screen patients for lung cancer so that it can be detected early enough to be treated.

To be effective, the screening must be inexpensive and accessible, researchers say.

The study plans to use volunteers who are currently between the ages of 50 and 75 and have had a minimum of 10 “pack years” of smoking. The eligible patients will undergo tests that range from questionnaires to blood draws in the hopes of determining factors that are unique to those diagnosed with lung cancer.

Thus far, researchers have examined several methods with no success.

In the Canadian study researchers believe that if a screening method is developed early detection will become the norm resulting in an increase in the five year survival rate to 70 percent.

Mesothelioma victim fights to stop his own autopsy

A Seattle man expected to die from an asbestos cancer is fighting a court requirement that he must undergo an autopsy after his death but before his estate can sue.

The victim said he objects to an autopsy on moral grounds and has filed a motion with the Seattle court asking that the autopsy requirement be waived, despite the adverse effect it could have on his lawsuit.

The defendants in the case are fighting the motion. Attorneys say that an autopsy is critical in discovering exactly what kind of asbestos cause the victim’s mesothelioma and claiming that, if he does not agree to an autopsy, his case should be dismissed.
