Mesothelioma and Lung Cancer Lawsuit

Wednesday, July 30th, 2008

Asbestos lawsuits are filed by plaintiffs who have suffered as the result of asbestos-related illness. Defendants are those parties considered responsible for the asbestos exposure. In the past, targets of asbestos lawsuits have included employers, asbestos manufacturers, and asbestos installers.

The purpose of asbestos lawsuits is to recover financial damages that result from asbestos related illness. Possible financial recoveries from asbestos lawsuits include cost of medical bills, loss of wage earning capacity, and other associated costs.          In some asbestos lawsuits, punitive damages (designed to punish the defendant) are also assessed. A few states permit asbestos lawsuits to be filed by people who reasonably expect to develop asbestos-related illnesses. These asbestos lawsuits regulations allow individuals exposed to asbestos to attempt to prepare financially for likely diseases. Many asbestos lawsuits have served to help publicize the adverse health effects of asbestos exposure; increasing numbers of asbestos lawsuits are decided for the plaintiffs as information about asbestos exposure becomes common knowledge.

Although asbestos lawsuits can be complicated at first glance, many individuals have been compensated for their losses caused by asbestos related illness, including mesothelioma and lung cancer. Mesothelioma and lung cancer can cause enormous medical bills and, sadly, often funeral costs. Filing a Mesothelioma Lawsuit

Monday, July 28th, 2008

People diagnosed with mesothelioma should file a lawsuit almost immediately upon diagnosis. Many states have placed a time limit on filing a mesothelioma lawsuit, and if a claim is not made as soon as possible it may be too late. It is therefore important for victims to contact a mesothelioma law firm such as Cappolino Dodd Krebs LLP and find out how long they have to file their lawsuit.  For the families and loved ones of mesothelioma patients who have already passed away, the regulations are slightly different but there still are deadlines that must be met. It is highly recommended that these families make contact with an experienced mesothelioma lawyer as soon as possible.           You may also be eligible to file a lawsuit if you suffer from respiratory problems and are the close family member of someone who worked with asbestos. Because asbestos fibers and dust were often carried on the clothes and personal items (such as lunchboxes) of workers, this material often found its way into their homes thus exposing other family members to the dangers. It is quite possible that family members could have contracted an asbestos-related disease from this method of exposure.           Whatever your connection with an asbestos-related disease – whether you suffer from mesothelioma, a family member who suffers from a related disorder, or a family member who is making a claim on behalf of a deceased loved one – it is important that you look into filing your lawsuit as soon as possible to increase your chances of a successful settlement. There are many legal problems which your lawyer will need to discuss with you in detail. In addition to this, the law firm may have to hire an investigator to determine when and where you or your loved one was exposed to asbestos. All this takes time, and with the time limitations that are set in most states, it means that you need to get the ball rolling as soon as you can.          Although it is impossible for your attorney to say when you will receive a settlement, how much you will get, or even whether your lawsuit will be successful, all mesothelioma sufferers or their families are entitled to look into the matter of filing a lawsuit. With most lawyers working on a contingency fee basis – that is, a percentage of any recovery, you will not need to worry about upfront costs or paying your lawyer if your lawsuit is unsuccessful.

Arizona Man Suffers From Mesothelioma

Monday, July 21st, 2008

An Arizona man who is currently suffering from mesothelioma recently filed suit against 59 defendants claiming they are to blame for his disease.  The man believes that due to  second hand exposure from his grandfather’s clothing he was unknowingly exposed to asbestos. He also says that he was wrongfully exposed to asbestos throughout his career doing home and automotive repairs.

He claims that during his employment he worked with and around products that contained asbestos. “Dust created by working with and around asbestos and asbestos-containing products would permeate the person and clothing of the plaintiff and plaintiff’s grandfather,” states the suit. “This dust contained asbestos fiber.” The plaintiff stated his grandfather would carry the asbestos dust home on his clothing and it would then become airborne.  The plaintiff was employed at various locations throughout Arizona and Illinois through the duration of his career.

The lawsuit alleges that as a result of his exposure, he developed the fatal cancer known as mesothelioma, which is caused by asbestos exposure.  He is seeking $350,000 in damages for negligence, conspiracy and the cost of his treatment.
