Removal of Asbestos Pile Begins in Iowa

          A pile of asbestos-containing debris is reportedly being removed from a Livestock Exchange in Sioux City, Iowa.  Water was reportedly poured on the asbestos pile before the construction crew began removing the pile of hazardous material.          The pile was left behind by a contractor who was hired to demolish the Livestock Exchange Building.  The City Council was given permission in December to contract a Michigan firm to remove the pile so exposure to the community would be prevented.  Asbestos was found in the pile, which was under a large tarp that was being held down by tires.          In 2004 workers who were removing the footing from the building that had been demolished on the property in 1998, discovered the pile of asbestos-ridden debris.  Since this time, the pile has reportedly been fenced and covered and tests have confirmed that the debris contained asbestos.

Home Inspectors are Encouraged to Disclose Asbestos to Potential Homebuyers

In the United States, there are about 35 million residential buildings that have structural elements that contain asbestos. Despite the prevalence of asbestos related building materials, home inspectors do not always search for asbestos during an inspection.

WOMAN DEVELOPS MESOTHELIOMA FROM EXPOSURE TO ASBESTOS IN HUSBAND’S WORK CLOTHES

A Texas woman, along with her husband and five children, filed suit in February against DuPont and several asbestos manufacturers because she developed mesothelioma from washing and handling her husband’s asbestos-contaminated work clothes for many years.  Her husband was a refinery worker at the Beaumont DuPont facility between 1957 and 1985.  She washed her husband’s dusty work clothes, not knowing they were covered with asbestos fibers.  She now suffers from asbestos-related pleural mesothelioma, an aggressive cancer that attacks the lining of the lungs.          Included as defendants are asbestos manufacturers, like Union Carbide, Anchor Packing Company, Guard-Line, Ingersoll-Rand and Owens-Illinois, that provided products to the DuPont facility and exposed her husband to asbestos without providing proper warnings that would have allowed him to protect himself and his family. DuPont is also a defendant because DuPont knew or should have known of the danger of asbestos exposure as well.

Asbestos Act Cannot be Applied Retroactively according to Florida Court

The Florida State’s Fourth District Court of Appeal has ruled that the Florida Asbestos and Silica Compensation Fairness Act cannot be applied retroactively to causes of action that are already in the process of litigation.

Under the act, plaintiffs are required to prove that the disease that they are suffering from as a result of asbestos exposure is malignant. Prior to the act, a case could be filed without proof of cancer or other permanent injury.

The act prevents those who have developed a minor form of asbestosis from filing a claim. Plaintiffs must prove that their lives are significantly impaired by the disease, or that cancer has developed as a result.
